Terms & Conditions – Hamdel

These Terms & Conditions (“Terms”) constitute a legally binding agreement between you (“User”) and Hamdel, a mobile application published under the name Hamdel Digital and operated by an individual owner (“Hamdel”, “we”, “our”, “us”).

By accessing or using the Hamdel mobile application (“App”), you agree to be bound by these Terms. If you do not agree, you must not use the App.

1. Eligibility & Community Restriction

1.1 Age Requirement
Hamdel is intended strictly for individuals aged 18 years and above.

1.2 Community Restriction
Hamdel is a community-specific dating and matchmaking platform intended exclusively for members of the Ismaili Muslim community.

By using the App, you represent and warrant that:

• You identify as a member of the Ismaili Muslim community, and

• You are using the App in good faith for its intended purpose.

Hamdel reserves the right to:

• Request verification of community affiliation

• Restrict, suspend, or terminate accounts that do not align with the intended community focus

Hamdel does not discriminate unlawfully but operates as a private, community-specific platform.

2. Nature of the Service

Hamdel is a dating and matchmaking service that enables users to:

• Create personal profiles

• Discover and view other profiles

• Communicate with other users

• Receive match suggestions using automated systems

Hamdel does not guarantee:

• Matches, compatibility, or outcomes

• User intentions, conduct, or identity

• Marriage, engagement, or relationship success

3. Account Registration & Accuracy

You agree to:

• Provide accurate, truthful, and up-to-date information

• Maintain the accuracy of your profile

• Safeguard your login credentials

You must not:

• Create fake, misleading, or duplicate accounts

• Impersonate another person

• Use another person’s identity or images without consent

4. Community Standards & Prohibited Conduct

To maintain a respectful and safe environment, users must not:

• Harass, threaten, stalk, or abuse others

• Engage in hate speech, discrimination, or violence

• Upload sexually explicit, pornographic, or obscene content

• Solicit money, gifts, investments, or financial information

• Promote scams, fraud, or illegal activity

• Share private or confidential information of others

• Use the App for commercial, advertising, or solicitation purposes

• Attempt to bypass moderation, verification, or security controls

Violations may result in content removal, account restriction, suspension, or permanent termination without notice.

5. User Content & License

Users are solely responsible for all content they submit, including:

• Profile information

• Photos and media

• Messages and communications

By submitting content, you grant Hamdel a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, display, modify (for formatting), and process such content solely for operating, improving, and promoting the App.

You retain ownership of your content.

6. Intellectual Property & App Use

All App software, branding, design, and features are the property of Hamdel or its licensors.

Users are granted a limited, revocable, non-transferable license to use the App for personal, non-commercial purposes only.

You must not:

• Copy, reverse engineer, decompile, or scrape the App

• Circumvent technical protections

• Use automated tools to extract data or profiles

7. Reporting, Blocking & Enforcement

Hamdel provides tools to:

• Report inappropriate content or behavior

• Block other users

Reports may be reviewed manually or via automated systems.
Hamdel may take action at its discretion and is not obligated to disclose investigation outcomes.

8. Safety Guidance (Advisory)

Users are encouraged to:

• Keep initial communications within the App

• Meet in public places

• Inform trusted individuals before in-person meetings

• Avoid sharing financial or sensitive personal information

Hamdel is not responsible for offline interactions between users.

9. Verification & Investigations

Hamdel may:

• Request profile, photo, or identity verification

• Use automated or manual review processes

• Cooperate with law enforcement or regulatory authorities when legally required

Verification does not guarantee user behavior or authenticity.

10. Subscriptions, Payments & Consumer Rights

Hamdel operates on a freemium model and may offer paid features or subscriptions.

• Prices and billing terms are disclosed at purchase

• Payments are processed via third-party platforms (e.g., Apple App Store, Google Play)

• Subscription management, cancellations, and refunds are governed by the platform used for purchase

Nothing in these Terms limits statutory consumer rights available under applicable law.

11. Account Suspension, Termination & Re-activation

Hamdel may suspend or terminate accounts:

• For violation of these Terms

• For safety, legal, or security reasons

• At its sole discretion

If an account is deleted, re-registration using the same credentials may result in reactivation of the prior account, subject to applicable laws and technical limitations.

12. Disclaimer of Warranties

The App is provided “as is” and “as available”.

Hamdel makes no warranties regarding:

• Availability or uninterrupted access

• Accuracy of profiles or matches

• User conduct or outcomes

Use of the App is at your own risk.

13. Limitation of Liability

To the maximum extent permitted by law:

• Hamdel shall not be liable for indirect, incidental, or consequential damages

• Hamdel is not responsible for user interactions or offline conduct

• Total liability, if any, shall not exceed the amount paid by the user in the preceding 12 months

14. Indemnification

You agree to indemnify and hold harmless Hamdel from claims arising from:

• Your use of the App

• Your content or interactions

• Your violation of these Terms or applicable law

15. Privacy

Use of the App is governed by the Privacy Policy, which forms an integral part of these Terms.

16. Third-Party Services

The App may integrate or link to third-party services. Hamdel is not responsible for third-party content, services, or practices.

17. Dispute Resolution & Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of India, without regard to conflict-of-law principles.

Courts located in India shall have exclusive jurisdiction.

18. Changes to the Service or Terms

Hamdel may update features or modify these Terms at any time. Continued use of the App constitutes acceptance of the revised Terms.
